These Terms & Conditions (the “Terms”) govern your access to and use of the communications services, websites, and applications provided by eTollFree, LLC (“eTollFree,” “we,” “us,” or “our”). Please read them carefully. By creating an account, purchasing a number, or using any part of our services, you agree to be bound by these Terms.
Agreement to These Terms
These Terms form a binding agreement between you and eTollFree, LLC. They apply to all visitors, customers, and account holders who access or use our toll-free, local number, VoIP, and related business communications services (collectively, the “Services”).
By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms, together with the policies referenced throughout, including our HIPAA & Privacy policy, Cancellation & Refunds policy, and Know Your Customer (KYC) requirements. If you do not agree, you must not use the Services. If you use the Services on behalf of a company or organization, you represent that you are authorized to bind that organization to these Terms.
Definitions
- “Account” means the account you register with eTollFree to access the Services.
- “Services” means the toll-free and local telephone numbers, call routing and forwarding, VoIP, messaging, and related communications services we provide.
- “Number” means any toll-free or local telephone number assigned to or used by you through the Services.
- “Content” means any data, voice, message, or other material transmitted, stored, or processed through the Services.
- “You” means the individual or organization that registers for or uses the Services.
Eligibility & Account Registration
You must be at least 18 years old and able to form a legally binding contract to use the Services. You agree to provide accurate, current, and complete information when you register and to keep that information up to date. We may refuse, suspend, or terminate accounts at our discretion, including where required for regulatory compliance.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your Account. Notify us promptly at [email protected] if you suspect any unauthorized use. eTollFree is not liable for losses arising from your failure to safeguard your credentials.
Know Your Customer (KYC) Verification
Before your account is activated, eTollFree is required to verify your identity through our Know Your Customer (KYC) process. The Federal Communications Commission (FCC) requires voice service providers to know their customers, so this step is mandatory for every new account. As part of our obligations under the TRACED Act and the STIR/SHAKEN caller ID authentication framework, you agree to provide the information and documentation we request and to keep it accurate. Accounts cannot be activated until KYC verification is complete, and we may re-verify your information at any time.

Description of Services
eTollFree provides toll-free and local telephone numbers and related business communications features, including call forwarding, routing, voicemail, messaging, and VoIP. Service features, availability, and pricing are described on our website and may be updated from time to time. We may add, modify, suspend, or discontinue any part of the Services, and we will use reasonable efforts to notify you of material changes that affect your use.
Acceptable Use & Prohibited Conduct
You agree to use the Services only for lawful business purposes and in compliance with all applicable laws, regulations, and these Terms. You may not, and may not permit any third party to:
- Use the Services for any unlawful, fraudulent, deceptive, or abusive purpose;
- Transmit unsolicited, illegal, or unauthorized calls or messages, including unlawful robocalls or spam;
- Spoof, falsify, or misrepresent caller identification or originating number information;
- Harass, threaten, defraud, or harm others;
- Infringe the intellectual property or privacy rights of others;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services, our networks, or other users; or
- Resell or rebrand the Services except as expressly authorized by us in writing.
Regulatory Compliance
You are solely responsible for ensuring that your use of the Services complies with all applicable telecommunications laws and regulations, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, federal and state Do-Not-Call requirements, robocall-mitigation rules, and STIR/SHAKEN caller ID authentication standards. You are responsible for obtaining any consents required before placing calls or sending messages.
Suspicious or Unknown Inbound Calls
From time to time you may receive calls to your toll-free or local numbers that you do not recognize. This is normal, particularly for numbers previously held by another business. eTollFree is not responsible for unwanted inbound calls and will not credit or refund charges associated with them. If unwanted traffic persists, the available remedy is to disconnect the affected number and select a different one.
Fees, Billing & Payment
Pricing for the Services is published on our website and may be updated from time to time. By purchasing or using the Services, you agree to pay all applicable charges, including recurring fees, usage charges, and any applicable taxes and surcharges. Current rates and plan details are available on our pricing pages.
Taxes & Regulatory Surcharges
Charges are exclusive of taxes, fees, and surcharges unless stated otherwise. You are responsible for applicable taxes and government- or regulator-imposed fees, including Universal Service Fund (USF) contributions and other telecom-related surcharges, which may appear as separate line items and may change as rates are adjusted.
Prepaid Balances & Automatic Billing
Certain Services operate on a prepaid balance and/or a recurring (auto-renewing) basis. Where the Services renew automatically, you authorize us to charge your payment method on file for recurring fees and usage until you cancel. It is your responsibility to keep a valid payment method and sufficient balance on file; we may suspend the Services for non-payment or insufficient balance.
Cancellation & Refunds
You may cancel the Services in accordance with our Cancellation & Refunds policy, which is incorporated into these Terms. Except as expressly stated in that policy or required by law, fees are non-refundable. Cancellation stops future renewals but does not retroactively refund charges already incurred.
Telephone Numbers & Portability
Telephone numbers assigned through the Services are provided for your use while your account is active and in good standing; you do not own a telephone number, and numbers may be subject to reassignment or regulatory requirements. Subject to applicable rules, you may port eligible numbers to or from eTollFree. Porting requests require an active account in good standing and completion of the required authorization, and a port-out fee and other conditions may apply. We are not responsible for delays caused by you or another carrier during the porting process.
Shared-Use Toll-Free (800) Numbers
Some of the toll-free numbers eTollFree offers are shared-use numbers. Only a number that is specifically flagged as “shared use” at the time you order it is a shared-use number, and shared use applies only to numbers in the “800” (8-0-0) code. If a number is not flagged as shared use when you order it, it is not a shared-use number.
A shared-use toll-free number is a number that may be used by more than one business at the same time, shared by country. For eTollFree’s shared-use 800 numbers, the number is available for your use within the United States, while the same number is already pre-assigned to other businesses in other countries. In plain terms: you use the number in the United States, and other parties use the same number outside the United States.
Because a shared-use number is shared, the following apply:
- You are assigned the right to use the number within the United States for as long as your account is active and in good standing. You do not receive exclusive ownership of the number, and, consistent with FCC rules, toll-free numbers are assigned to subscribers rather than sold outright.
- You will generally receive only calls (and, where applicable, text messages) that originate within the United States. Traffic originating in other countries may be handled by the business that holds the number in that country.
- Shared-use numbers remain under eTollFree’s Responsible Organization (RespOrg) control and are not portable — they may not be transferred to another provider or subscriber, because more than one business uses them.
- eTollFree does not control, and is not responsible for, the conduct of businesses that use the same number in other countries.
- Shared-use numbers are offered on a first-come, first-served basis and remain subject to these Terms, including our Acceptable Use, Know Your Customer (KYC), and Fraudulent Account Policy provisions.

Emergency Services (E911) Limitations
eTollFree’s Services are primarily inbound and business communications services and are not a replacement for traditional telephone service. The Services may not support 911 or E911 emergency calling, and you should not rely on them to reach emergency services. Where any emergency-calling capability is offered, it may have limitations — including during power, internet, or service outages, or where location information is inaccurate or unavailable. You are responsible for maintaining an alternative means of contacting emergency services and for informing users of the Services of these limitations.
Service Availability & Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, or secure, and we do not guarantee any specific uptime unless set out in a separate written service-level agreement. To the fullest extent permitted by law, eTollFree disclaims all warranties, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, eTollFree and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Services or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by law, eTollFree’s total aggregate liability for any claim arising out of or relating to the Services will not exceed the amount you paid to eTollFree for the Services during the three (3) months immediately preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless eTollFree, LLC and its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your Content, your violation of these Terms, or your violation of any law or the rights of any third party.
Fraudulent Account Policy
To protect our platform, customers, and regulatory compliance, eTollFree reserves the right to assess and take action on accounts suspected of fraudulent or abusive activity.
Accounts identified as potentially fraudulent—including those flagged by the FCC, other regulatory bodies, or law enforcement agencies—may be subject to additional review and restrictions.
As part of our fraud mitigation process:
- A $500 security deposit will be required for any account under investigation.
- This deposit is held to cover potential chargebacks, abuse-related damages, or regulatory liabilities.
- Accounts deemed fraudulent may be suspended or terminated without notice, and no refunds will be issued for any unused services or balances.
We take these actions in accordance with our commitment to maintaining a secure, compliant service for all users. If you believe your account has been flagged in error, please contact our support team for a formal review.
Intellectual Property
The Services, including all software, text, graphics, logos, and trademarks, are owned by eTollFree, LLC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services except as expressly permitted.
Privacy
Our collection and use of personal information in connection with the Services is described in our HIPAA & Privacy policy, which is incorporated into these Terms. By using the Services, you consent to the data practices described in that policy.
Suspension & Termination
We may suspend or terminate your access to the Services, in whole or in part, at any time if you violate these Terms, fail to pay amounts due, create risk or legal exposure for eTollFree, or where required for regulatory or security reasons. You may stop using the Services at any time in accordance with the cancellation process. Upon termination, your right to use the Services ends, and any provisions that by their nature should survive — including payment obligations, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.
Dispute Resolution & Binding Arbitration
Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.
Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at [email protected] and giving us at least thirty (30) days to resolve it.
Binding arbitration. Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by final and binding individual arbitration, rather than in court, administered under the rules of a recognized arbitration provider and conducted in the State of Texas. The arbitrator’s decision will be binding and may be entered as a judgment in any court of competent jurisdiction.
Class-action waiver. You and eTollFree agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class proceeding.
If any portion of this section is found unenforceable, the remainder will continue to apply, except that if the class-action waiver is found unenforceable, this entire arbitration section will be void.
Governing Law
These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to the arbitration provisions above, the exclusive venue for any matter not subject to arbitration will be the state or federal courts located in Texas, and you consent to their jurisdiction.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
Force Majeure
eTollFree will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, power or internet failures, network or carrier outages, labor disputes, governmental actions, or other force-majeure events.
Miscellaneous
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with the policies referenced in them, constitute the entire agreement between you and eTollFree regarding the Services and supersede any prior agreements. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce any provision is not a waiver of our right to enforce it later.
